Community Policies

1A. Enrollment Policy: 

 

 

Students and parents are encouraged to make the choice to enroll at Legacy Preparatory Academy with full consideration of the curriculum, expectations and college preparatory learning environment at Legacy Preparatory Academy.

 

Any student who has been expelled from any school, including Legacy Preparatory Academy, during the preceding 12 months will be denied enrollment (Utah State Code 53A-11-904(3)). Students with other prior behavior problems will not be enrolled at Legacy Preparatory Academy unless and until they have fulfilled all requirements established in conjunction with (a) suspension from any previous school, including Legacy Preparatory Academy, and (b) any intervention program in which they are currently enrolled; and (c) they have demonstrated success in correcting prior behavior problems for 90 school days. Where there is doubt, burden of proof of successful completion of mandated programs and successful avoidance of problematic behavior incidents rests with the student’s family. Conditions under which enrollment might be permitted or continued at Legacy Preparatory Academy will be established in a traditional monitoring agreement at the time of enrollment. Safe school offenses from any school, including Legacy Preparatory Academy, during the preceding 12 months will follow a student to Legacy Preparatory Academy for a subsequent school year. In such cases, the offenses and the consequences for a repetition will be specified in the transitional monitoring agreement.

 

A student’s enrollment may be revoked if conditions of an enrollment agreement are broken, or if Legacy Preparatory Academy receives new information at any time about preexisting unresolved behavior issues. Parents have the right to appeal a termination of student enrollment to the Governing Board. To do so, parents must notify the President of the Legacy Preparatory Academy Governing Board, in writing, within ten working days of receipt of a denial letter.

 

Truancy citations issued from any school, including Legacy Preparatory Academy, during the preceding 12 months will follow a student to Legacy Preparatory Academy for a subsequent school year (State Board Rule 277-607-3). Any student who has unresolved truancy issues from their previous school year will be enrolled on probation and truancy procedures will continue as necessary.

 

 

Lottery Policy and Procedures: 

 

Admission to Legacy Preparatory Academy

Legacy Preparatory Academy is part of the public education system and offers enrollment for students in grades K-9.

 

LPA complies with all federal and state admission policies, which include an open admission, and will not discriminate on the basis of race, religion, age, gender, handicap, or any other specification protected by law.

 

Current Students: Currently enrolled LPA students in good standing* who request continuing enrollment by a date designated each school year will be guaranteed placement for the following school year.

 

Prospective Students: All parents wishing to enroll new students in Legacy Preparatory Academy must submit an online application; which includes the required information for each prospective student.

 

Open Enrollment and Lottery

Open enrollment is for all families with new students for the upcoming school year including:

 

  • Any non-registered children and siblings of LPA founding families.
  • Any non-registered siblings of students that are already registered and attending LPA for the current school year.
  • All other non-registered students who wish to attend LPA.
 

Submission of a New Student Inquiry does not guarantee enrollment of applicant during the open enrollment period.

 

When the capacity for any grade level has been reached, enrollment will be held in accordance with state and federal law to conduct its application and enrollment procedures using a random lottery.

 

Lottery enrollment enables charter schools to cap enrollment at the population size authorized by the charter with the State Board of Education. Charter schools are unable to receive any per-student funding beyond their charter’s target enrollment.

 

Notification and Response Deadlines:  Parents will be notified via e-mail and/or phone.  It is the responsibility of parents to ensure that the school has their current contact information and to respond in a timely manner to an offer of admission.  Legacy Preparatory Academy will attempt to contact parents regarding their child’s admission a minimum of two times.  If the parent cannot be contacted or is non-responsive within a designated time period, the available space may be offered to another waiting student.  Response deadlines are calculated from the first attempted contact as follows:

Final Registration: Parents who accept admission are provided with required registration materials to complete student registration as well as a firm deadline for submission of all registration materials. If the designated registration deadline is not met, the available space may be offered to another waiting student.

 

Lottery Procedures

During the lottery, names will be drawn randomly one at a time. As a student is selected, their siblings will also be offered a placement, as requested and possible. This process will continue until school enrollment capacity has been reached.


The total number of students to be accepted at LPA for each school year will be determined prior to the lottery.

 

Wait List

The law calls for a Lottery/Wait List when student enrollment population has reached the state allotted cap.

 

Wait Lists are prioritized as follows:

 

  • Children of Founders
  • Siblings of registered students* who are in good standing at their current school and request enrollment by the designated date each school year
  • Children of LPA staff
  • Students articulating from another charter school which has an articulation agreement with LPA
  • All other registration requests
 

When student numbers have been assessed and it is determined there are openings; families with students on wait list will be notified of their acceptance. Upon notification of acceptance, a signed copy of an acceptance form must be returned to Legacy Preparatory Academy with the completed registration forms within 10 days to start the enrollment process. If acceptance form is not returned within the allotted 10 days of notification it is determined the space is unclaimed and will be offered to the next student on the wait list.

 

Information regarding student status on the waiting list, or chances are of being drawn will not be given out, as staff cannot provide answers to these questions.

 

Continued Enrollment for the next School Year

After the initial Open Enrollment/Lottery/Wait List the school will continue to accept New Student Inquiry applications. The new applications received after the closing date of the Open Enrollment will be placed on the wait list and will be processed in the order in which they are received.

 

Please Note: In accordance with Utah State Law, children must turn five (5) on or before September 1st of the school year in order to enroll in kindergarten. Children who do not meet the age requirement will not be enrolled.

 

NOTICE TO PARENTS REGARDING UNENROLLMENT FROM A CHARTER SCHOOL

 

We would like to inform parents about some new laws that affect students transferring from a charter school to a district school so that you can plan accordingly and not be caught off guard. Unfortunately, if these new requirements are not followed, a student could lose their spot in the charter school and subsequently not be able to enroll in the district school of their choice either. 

 

Utah state law establishes procedures that govern the withdrawal of students from charter schools for enrollment in district schools. See Utah Code. § 53A-1a-506.5 and Utah Admin. Rule R277-472. 

 

Specifically, Utah law states that parents are to provide notice by June 30thof their intent to withdraw from a charter school and enroll in another school (either a district school or another charter school) for the following year. If the parent applies for admission to their school district of residence for the following year before June 30th, the school district must accept the student into the student’s school of residence.

 

For example, if, during the 2013-2014 school year a parent intends to withdraw their student from a charter school and re-enroll in their neighborhood district school for the 2014-2015 school year, they should notify both the charter school and their local school district of that intent prior to June 30, 2014. The district is required to enroll the student in their local neighborhood school.

 

If a parent wants to withdraw a student from a charter school after June 30th or during the school year, state law requires the parent to first go to the school district or other charter school and obtain a letter of acceptance for enrollment in the new school. The parent then needs to give the charter school a copy of that letter of acceptance. Also, in this situation, the local school district is not required to accept the student into their school of residence if the parent did not notify the district before June 30th. The district is only required to accept the student into a school in the district that has “adequate capacity”.

 

For example, if the parent in the above example fails to register the child in the neighborhood district school prior to June 30, 2014, the district doesn’t have to allow the student to enroll in their neighborhood school if that school doesn’t have “adequate capacity” for the 2014- 2015 school year. The district would then tell the parent which school has capacity for their child and the parent would be responsible for transportation to that school.

 

School districts should post information to their websites about which schools in the district have adequate capacity. If they have not done so, you should contact the district office and request that information. We don’t want anyone to be caught in a difficult situation, so if you plan to enroll your student in a district school next year, please understand and follow these requirements.

 

If you choose to un-enroll your student from our school, then change your mind, you will have to Re-enroll your child through the lottery with LPA, and we cannot guarantee re-entry into the school regardless of the situation.
